All users are solely responsible for the safety and management of their private wallets on the Solana blockchain. Please note that transactions on this public network cannot be reversed or restored.

• "MNK3Y" refers to the character and asset within the MNK3YS NFT collection.

• "MNK3YLABS" refers to the parent entity created by D34N0.eth and registered on ON, Canada. 

• "OWN" is defined as the possession of a MNK3YLABS NFT in your Solana wallet, with proof of ownership on the public blockchain.

• "MNK3Y VAULT" is defined as a treasury for the community of holders.

• "MNK3Y PHILANTHROPY" is defined as a charitable fund for the community of holders.

 

OUR OWNERSHIP

We hold the name and intellectual property associated with "MNK3YLABS," "MNK3YS," and "MNK3YJUICE" as used on the blockchain and related outlets. All rights not explicitly granted to users and MNK3Y token owners are reserved for the project. This includes official logos, custom artwork, trademarks, the website, the brand's aesthetics, the character's design, the smart contract code, and all other assets not covered by specific licenses.

We retain the right to use your assets in marketing materials. If you possess an asset at the commencement of any community activations, you may choose to opt out. However, if you acquire an asset already used in marketing, you forfeit the right to opt out and accept the terms established by the previous participant. The sale of an asset during a bound state relinquishes all rights to the asset, which are transferred to the new owner. Any assets used in product placement will undergo a prior review and be subject to legal binding. By purchasing an NFT in the legally bound state during community activations that benefit the community, you agree to these terms, taking on the associated legal obligations. All proceeds from such activations are directed to the community treasury.

 

YOUR OWNERSHIP

You possess the rights to your "MNK3YS" NFT and any accompanying art airdropped to you, granting you a royalty-free license to use, copy, and modify these assets worldwide. You are permitted to use your NFTs on merchandise, such as shirts or bags, but you must refrain from using the official branding or any logos created by MNK3YLABS, which might be misconstrued as our official merchandise release. You may use the word "MNK3Y" independently with your NFT and employ the term "MNK3Y" in your desired typeface and placement. NFT ownership is verified on the public Solana blockchain, serving as proof of ownership and granting rights within this webpage. When an NFT leaves your possession, all personal and commercial usage rights are revoked.

 

COMMERCIAL USE & DERIVATIVE WORK

Any use of MNK3YLABS NFT licensed materials must be complete and unaltered. The licensed use of the character and any custom artwork should include the entire image, with the exception of the background, which may be removed. Individual expressions and traits are exclusive to MNK3YLABS and may not be used separately from the complete image. Counterfeit NFTs or knock-offs of our art are prohibited and will be subject to DMCA actions by the law firm of MNK3YLABS. NFT knock-off collections created to impersonate genuine MNK3YLABS creations will be reported and subject to DMCA as well.

Participants must refrain from using MNK3YLABS licensed materials in connection with organizations or materials that are unlawful, fraudulent, offensive, or otherwise objectionable. Any misuse of the asset is the responsibility of the holder, and we disclaim liability for any charges made against the holder, including the use of nude or pornographic material.

 

NOT AN INVESTMENT INSTRUMENT

Assets in this collection and items used on this website are intended for entertainment purposes and should not be considered investment vehicles. The art provided by MNK3YLABS is meant to function as enjoyable digital collectible assets and should not be used as financial instruments. We do not make promises or guarantees regarding the value of our tokens, and we cannot ensure that your NFT will be selected for licensing opportunities within any specific timeframe of the project. The fulfillment of any roadmap activations and delivery times is not guaranteed.

As part of this project, we offer giveaways and contests as a form of charitable donations.

 

GIVEAWAYS AND CONTESTS

Holders of MNK3YLABS NFTs have the opportunity to participate in future releases, including airdrops, merchandise drops, and more. In the case of physical giveaway prizes, if you choose not to provide a mailing address, we reserve the right to provide the equivalent value in SOL instead. The execution and timing of any advertised utility or contest are subject to the prevailing value of the Solana token, and all activations are at the discretion of MNK3YLABS. Participation in these activities is subject to the rules and guidelines of all parties and companies involved.

 

TAXES

You are solely responsible for any tax obligations that may arise from minting, trading, or owning MNK3YLABS NFTs.
